GENERAL PROVISIONS:

1.1 The Facility: Vertical Rock Indoor Climbing and Fitness Centers & Team Redpoint DBA., Vertical Rock Tysons

1.2 We encourage everyone to thoroughly read and understand our participant and observer rules and facility regulations. These are prominently displayed throughout our facilities. A copy of these rules and regulations are available upon request. Please feel free to ask one of us for any clarification regarding these. Everyone must abide by these rules and regulations while in the Facility.

1.3 We may amend our rules and regulations from time to time to ensure the health and wellbeing of our members and guests. Temporary amendments will be displayed in the facility or posted via social media. Permanent changes to the Facility Rules will only be made after at least 30 days’ notice to members, except in the case of emergency.

1.4 Participant Agreement. Each Member or their Legal Guardian must execute a “Participant Agreement” online, or in person at the Facility before taking part in any type of activity offered at VR. This agreement may be amended from time to time and is required to be renewed by each participant on an annual basis, or as prompted by the Facility.

1.5 Skill Testing and Access. All users electing to participate in any roped climbing without an instructor must pass the specified Facility tests or certification requirements provided by the Facility.

1.6 We reserve the right to adjust the availability of certain activities or close the facility on a temporary basis for the general purpose of competitions, severe weather, maintenance of equipment, special functions, private events, and holidays.

1.7 Severe weather. In the event of severe weather, we may adjust our operating hours, or close temporarily. If these closures take effect, the affected Facility will do its best to communicate the limited hours through our social media.

1.8  In alignment with Prince William County and Fairfax County guidelines for canceling school and afterschool programs due to severe weather, VR will also suspend all youth teams and youth programs until the county(s) reopens. These program cancellations are still valid even if the Facility should remain open to the public.

1.9. Personal Property. We are not responsible nor liable for any lost, stolen, or damaged items.  If you believe you have misplaced or lost an item on our premises, please inform our staff as soon as possible. While we will do our best to assist you in locating lost items, we cannot guarantee their recovery.

2.0 Third Party/Affiliates. (EFT) Billing and Collection efforts are managed by a Third-party service. You may see a different company name other than ours when your account is debited or credited.

MEMBERSHIP CANCELLATION POLICY

2.1 Monthly Recurring accounts “will not” automatically cancel or expire. If you do not want to be on auto renewal, please notify us that you do not wish to renew your membership after your initial term expires.

2.2 All overdue or previous balances on the account must be paid prior to cancellation.

2.3 Any Prepaid membership accounts will terminate automatically at the end of the duration purchased.

2.4 Prepaid cancellation requests are not applicable.

2.5 Any Requests to cancel must be made 30 days prior to the billing date or abide by the conditions set forth in (Section III) of your membership agreement, and by the required forms of “Notice” (Paragraph, 11) The account holder must include “Contact information, A reason for the cancellation, and the Date requested for cancellation”.

NOTICES:

2.6 Requests must be received 30 days in advance of your next billing cycle. All billing is transacted on the 1st of the month.

2.7 All Notices or cancellation requests must be in an email to: Info@climb-va.com We do not accept any walk-in, over the phone or faxed notices/requests regarding member accounts. We may require evidence of posting or delivery if there is no record of receipt or the date of any notice appears inconsistent with the date of receipt. In these cases, the notice will be deemed not given unless such evidence is produced. Any notice delivered to the Facility must have a valid date of receipt.

2.8 We strive to provide a response within 72 hours of your request. If no response has been received, please resubmit your response in line with your original email request/notice.

2.9 Notices from the Facility and/or our Business Affiliates to you will be sent via the account holder’s email address on file.
